13. ACCEPTANCE OF TERMS
By accessing, browsing, or purchasing from BySeah.com, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to these terms in full. If you are acting on behalf of a business entity, you represent that you have authority to bind that entity to these terms.
14. ACCOUNT RESPONSIBILITY
You are solely responsible for:

— Ensuring your account information is accurate and up to date
BySeah shall not be liable for any loss or damage arising from unauthorised access to your account resulting from your failure to safeguard your credentials. You must notify us immediately upon becoming aware of any unauthorised use of your account.
15. PRODUCT ACCURACY & AVAILABILITY
We make every reasonable effort to display products accurately, including descriptions, images, specifications, and pricing. However:
— Colours may vary due to monitor settings and display calibration
— Product packaging and specifications may be updated by manufacturers without notice
— Minor variations that do not affect functionality are not considered defects
— Product availability is not guaranteed and is subject to change without notice
BySeah reserves the right to limit quantities, refuse orders, or cancel orders at any time for any reason, including but not limited to errors in product or pricing information, suspected fraud, or stock unavailability. Where an order is cancelled, we will issue a full refund of any payment received.
16. PRICING & ERRORS
All prices are displayed in the applicable transaction currency and are subject to change without prior notice. In the event of a pricing error:
— We reserve the right to cancel any order placed at an erroneous price
— We will notify you of the error and offer the option to reorder at the correct price or receive a full refund
— BySeah shall not be obligated to honour orders placed at incorrect prices
BySeah is not responsible for typographical or system errors that result in inaccurate pricing or product information.
17. INTELLECTUAL PROPERTY
All content on BySeah.com — including but not limited to brand names, logos, product photography, graphic elements, text, videos, page layouts, and design — is the exclusive property of BySeah, SeahStore.com, or their respective licensors and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, republish, download, display, post, transmit, or use any content from this platform in any form or by any means without our prior written permission. Any unauthorised use may result in civil and criminal liability.
18. PROHIBITED CONDUCT
You agree not to:
— Use the platform for any unlawful purpose or in violation of any applicable laws
— Submit false, misleading, or fraudulent orders or information
— Engage in any conduct that disrupts or interferes with platform functionality
— Attempt to gain unauthorised access to any part of the platform or its systems
— Use automated tools, bots, or scrapers to access or extract data from the platform
— Circumvent, disable, or interfere with security-related features
— Engage in abusive, threatening, or harassing behaviour toward BySeah staff or other users
— Abuse return, refund, or exchange policies
19. FRAUD PREVENTION & ORDER VERIFICATION
BySeah employs fraud detection and prevention measures. We reserve the right to:
— Verify order and payment details prior to fulfilment
— Require additional identification or documentation for high-value or flagged orders
— Cancel or refuse any order that we reasonably suspect to be fraudulent
— Suspend or permanently terminate accounts engaged in fraudulent activity
— Report suspected fraud to relevant law enforcement authorities
BySeah shall not be liable for any delays or losses arising from fraud verification procedures undertaken in good faith.

PART C — SHIPPING POLICY
20. INTERNATIONAL SHIPPING
BySeah ships to selected countries worldwide. Shipping availability, carriers, and delivery timeframes are subject to change without notice.
Estimated delivery times are provided for informational purposes only and do not constitute a guarantee. Actual delivery may vary due to:
— Customs processing and clearance
— Carrier delays, strikes, or operational disruptions
— Force majeure events (see Section 27)
— Incorrect or incomplete shipping information provided by the customer
— Public holidays and peak shipping periods
BySeah is not responsible for delayed, lost, or damaged shipments once goods have been dispatched and are in the possession of the carrier, except where otherwise required by applicable law.
21. CUSTOMS, DUTIES & TAXES
All international shipments may be subject to customs inspection. The customer is solely responsible for:
— All import duties, customs fees, and taxes levied by the destination country
— Obtaining any required import permits or licences
— Compliance with destination country import regulations
BySeah has no control over customs procedures and cannot predict or guarantee customs clearance timelines or fees. Refusal to pay applicable customs charges or failure to comply with import regulations may result in the shipment being returned, abandoned, or destroyed. In such cases, BySeah shall not be obligated to issue a refund for the order or original shipping costs.
22. INCORRECT SHIPPING INFORMATION
If an order cannot be delivered due to an incorrect, incomplete, or undeliverable address provided by the customer:
— BySeah is not responsible for the non-delivery
— Redelivery fees may apply
— Original shipping costs are non-refundable
— BySeah reserves the right to deduct return shipping costs from any applicable refund

PART D — RETURNS, EXCHANGES & REFUNDS
23. RETURN POLICY
Return window: 14 days from confirmed delivery
Customers may request a return, exchange, or refund within 14 days of the confirmed delivery date, subject to the conditions below.
Eligible return conditions — items must be:
— Unused or lightly tested
— In their original condition
— In original packaging where possible
— Complete with all accessories, manuals, tags, and included items
— Free from signs of misuse, intentional damage, or abuse
BySeah reserves the right to inspect returned items and reject returns that:
— Show evidence of use, wear, or damage beyond light testing
— Are missing essential components, accessories, or documentation
— Have been altered, modified, or tampered with
— Were returned without prior authorisation
— Do not meet the conditions stated above
Unauthorised returns may be returned to the customer at their expense or held pending resolution.
24. NON-RETURNABLE ITEMS
The following categories are not eligible for return under any circumstances:
— Hygiene and personal care products
— Intimate apparel and swimwear (for hygiene reasons)
— Personalised, custom-made, or engraved items
— Final sale, clearance, or promotional items marked as non-returnable
— Gift cards, vouchers, and store credit
— Consumable, perishable, or hazardous goods
— Opened software, digital downloads, or products with broken seals
— Any product explicitly marked as non-returnable on its product page
Exceptions to this list may only be made in cases of confirmed product defect or fulfilment error, at BySeah's sole discretion.
25. DAMAGED, DEFECTIVE, OR INCORRECT ITEMS
If your order arrives damaged, defective, or incorrect, you must:
— Notify BySeah within 7 days of confirmed delivery
— Provide your order number, full name, description of the issue, and supporting evidence (photographs and/or video of the item and packaging)
Failure to report within this timeframe may affect your eligibility for resolution. Upon review, BySeah may offer one or more of the following remedies at its discretion:
— Full or partial refund
— Replacement item
— Exchange for an equivalent product
— Store credit
BySeah reserves the right to request the return of defective or incorrect items prior to issuing a resolution. Return postage will be covered by BySeah in confirmed cases of defect or fulfilment error.
26. EXCHANGES
Exchanges are available for a different size, colour, variant, or equivalent product, subject to availability. Where the replacement item:
— Is of higher value: the customer must pay the price difference prior to dispatch
— Is of lower value: the remaining balance will be refunded to the original payment method or issued as store credit, at the customer's preference
Exchanges are subject to stock availability and cannot be guaranteed. If the requested exchange item is unavailable, a refund or store credit will be offered.
27. REFUNDS
Approved refunds will be processed to the original payment method within 5–14 business days of approval. Actual processing time may vary depending on:
— Payment provider and card issuer
— Country of the originating transaction
— Applicable currency conversion processing
Shipping fees are non-refundable unless the return is the direct result of a BySeah error, product defect, or incorrect fulfilment.
Store credit issued as refund has no expiry date unless otherwise stated at time of issuance.
28. RETURN SHIPPING
Unless the return is due to a confirmed defect or BySeah error, return shipping costs are the sole responsibility of the customer. We strongly recommend:
— Using a tracked and insured shipping method
— Retaining proof of postage
BySeah is not responsible for return items lost, damaged, or delayed in transit. Prepaid return labels may be issued at BySeah's sole discretion in select cases. Items returned using prepaid labels for reasons other than defect or error may have the cost of the label deducted from the refund amount.

PART E — LIMITATION OF LIABILITY & LEGAL PROVISIONS
29. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, BySeah, SeahStore.com, their directors, officers, employees, agents, suppliers, and licensors shall not be liable for:
— Any indirect, incidental, special, consequential, or punitive damages
— Loss of profits, revenue, data, goodwill, or business opportunities
— Damages arising from your inability to access or use the platform
— Damages resulting from unauthorised access to or alteration of your data
— Any errors, inaccuracies, or omissions in platform content
— Delays or failures in delivery attributable to customs, carriers, or force majeure
— Any loss arising from reliance on third-party services integrated with the platform
In all cases, BySeah's maximum aggregate liability to you shall not exceed the total amount paid by you for the specific order giving rise to the claim.
Nothing in these terms shall limit liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
30. DISCLAIMER OF WARRANTIES
The platform and all content, products, and services provided through it are offered on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
BySeah does not warrant that:
— The platform will be uninterrupted, error-free, or secure
— Defects will be corrected
— The platform or its servers are free of viruses or harmful components
— Results obtained from using the platform will be accurate or reliable
Your use of the platform is at your sole risk.
31. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless BySeah, SeahStore.com, and their affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:
— Your use of or access to the platform
— Your violation of these terms
— Your violation of any applicable law or third-party rights
— Any content you submit, post, or transmit through the platform
— Any fraudulent, abusive, or unauthorised use of your account
32. FORCE MAJEURE
BySeah shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to:
— Acts of God, natural disasters, floods, earthquakes, or pandemics
— War, terrorism, civil unrest, or government actions
— Strikes, labour disputes, or industrial action
— Failure of third-party infrastructure, telecommunications, or internet services
— Import or export restrictions, embargoes, or sanctions
— Carrier disruptions or port closures
In such events, our obligations will be suspended for the duration of the force majeure event. We will use reasonable efforts to notify affected customers and resume normal operations as soon as practicable.
33. GOVERNING LAW & DISPUTE RESOLUTION
These terms shall be governed by and construed in accordance with the laws of Kuwait, without regard to its conflict of law provisions. For international customers, applicable consumer protection laws of your country of residence may also apply and are not excluded by this clause.
In the event of a dispute, we encourage you to contact us directly to seek resolution. If a dispute cannot be resolved amicably, it shall be submitted to the competent courts of Kuwait, unless mandatory applicable law requires otherwise.
34. CLASS ACTION WAIVER
To the extent permitted by applicable law, you agree to resolve any dispute with BySeah on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
35. SEVERABILITY
If any provision of these terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity and enforceability of the remaining provisions.
36. ENTIRE AGREEMENT
These terms, together with our Privacy Policy and any other policies published on BySeah.com, constitute the entire agreement between you and BySeah with respect to your use of the platform and supersede all prior agreements, representations, and understandings.
37. POLICY UPDATES
BySeah reserves the right to amend, update, or replace any part of these terms at any time. Changes will be posted on this page with a revised effective date. Your continued use of the platform following the posting of changes constitutes your acceptance of those changes. We encourage you to review this page periodically.
